There are many different layers as to how Black people can empower themselves. However, before they begin, they must recognize and accept the fact that they themselves may not benefit from the fruits of their labor, but our their children surely will (and generations thereafter).

As it pertains to police brutality, here is a method (if everyone attempts to use it) that will probably work. From studying history and law over the years, an unidentified person (who wants to remain totally anonymous) has determined a method of correcting the issue with police brutality and the murder of black and brown people.

The solution is to bankrupt and disrupt the police department.

Here’s how: A lot of the money used to fund the police department comes from the municipal level (i.e., traffic court). This was the major issue that caused most of the drama that arose in Ferguson Missouri. The police would ticket the poor and black community to finance their departments. Many municipalities implement this same formula throughout the country. In most municipal courts, the unwritten policy is to load as many cases on the docket per hour and try to get the defendant to settle (i.e., cases of defensive driving, probation or just pay the ticket). In the municipal court in many major cities, they have at least 75 cases heard per hour for at least 6 hours a day, even on weekends. If they get all those cases settled (without having to go to trial) that creates a major cash cow – and a mighty good hustle for the municipality.

Most black and brown folks don’t have the time to take off from their jobs, therefore, they just simply pay the ticket, which is why you find “random” traffic stops in poor neighborhoods instead of rich neighborhoods. It’s good business. Get the money from those who are more likely to give it without a hassle.

So let’s do the math. A “no insurance ticket” is about $400+. If you pay the ticket, it’s still $400+, if you take it to trial and you are found guilty, it’s still $400+. If you settle and take defensive driving or probation, it’s less, but the court still doesn’t have to use any of its resources. However, if the defendant defers and takes the case to trial they have the option of choosing trial by judge (which takes about an hour) or a trial by Jury (which takes about 8 hours – for one case).

Imagine if in every one of those 100+ cases the defendant decided to take their case to a jury trial. That means that the court would literally have to have a jury trial (one a day) over the course of two or more years or so. The court would have to pay the judge for eight hours, the cops would

have to show up to court for eight hours, the clerk, staff, etc….. This would destroy the municipality financially and keep officers from writing tickets (i.e., execute traffic stops, etc.) because it would be very time consuming and cost too much money. Plus, the officers cannot justify sitting in traffic court for eight hours a day, especially if they have to go back to back for two or more years straight.

In addition, think about the yearly “round up” the courts do for those who have unpaid tickets. It’s logistically impossible for every officer to execute every warrant. There is literally millions of dollars in unpaid traffic citations in major cities around the country. Therefore, the court makes contacts with their media connections to “scare” folks into paying the tickets or risk getting a knock on the door from an officer executing an arrest warrant – very scary. It’s the perfect scare tactic and it works. Traffic court is a mad house with people giving up their rent money and not paying their bills during the “round up” week. The cops just sit back and collect. The court system sits back and collects. The major cities sit back and collect.

Unfortunately, writing policy (or new laws) won’t help. It never has and it never will. The issue is not the aw itself, but as to how its selectively applied (usually against black folks, e.g., Black Codes, Jim Crow, Separate but equal, etc.).

Encourage everyone you know (especially black and brown folks – who make up 90% of the traffic citations) to take their case to jury trial, AND NEVER SETTLE.

If we have to pay for the tickets, make them work for that money,

not give it to them for free.
